1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Fantasy Archery website, game and related services (together, the “Service”), operated by Emiel Custers Archery, Tellingsstraat 5, 6011NC, Ell, Netherlands (“Fantasy Archery”, “we”, “us” or “our”).

Fantasy Archery is a free online sports prediction game inspired by fantasy football and similar formats. You create an account, use a virtual budget to assemble a team of real international archers, and take part virtually in real international archery competitions. You earn points based on how the archers you selected actually perform in those competitions. Physical prizes are made available for individual events and for the overall season.

By creating an account, accessing the website or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.



2. Definitions

  • “Account” means the personal account you register in order to use the Service.
  • “Player”, “you” or “your” means the natural person who registers and uses an Account.
  • “Team” means the selection of real-world archers a Player assembles within the Service using the virtual budget.
  • “Virtual Budget” means the non-monetary, in-game allowance used to select archers for a Team. It has no cash value and cannot be bought, sold, transferred or redeemed.
  • “Event” means a real-world international archery competition, or a stage or phase of such a competition, that we designate as scoring for the Service.
  • “Season” means a period we define that groups multiple Events together for the purpose of an overall ranking.
  • “Points” means the score attributed to your Team based on the real-world results of the archers you selected, calculated according to our scoring rules.
  • “Leaderboard” means any ranking of Players by Points, whether per Event, per Season or otherwise.
  • “Prize” means any physical reward we make available in connection with an Event or a Season.
  • “Content” means any data, text, images, names, results, statistics, graphics and other material made available through the Service.

3. Eligibility

To register and use the Service you must:

  • be at least 16 years old, or older if a higher age of digital consent applies where you live; and
  • have the legal capacity to enter into a binding agreement with us; and
  • not be barred from using the Service under the laws of your country of residence or under a previous suspension or termination by us.

If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We may ask you to verify your age or identity at any time, in particular before a Prize is awarded, and may withhold access or Prizes until verification is complete.

The Service is offered from The Netherlands. We make no representation that the Service is appropriate or available in other locations. You are responsible for complying with local laws, including any laws that restrict online games or the receipt of prizes.



4. Account Registration and Security

You must provide accurate, current and complete information when registering and keep that information up to date. You may hold only one Account. Creating multiple Accounts, or registering on behalf of another person without authorisation, is prohibited.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your Account. You must notify us promptly at privacy@fantasy-archery.com if you suspect any unauthorised use of your Account. We are not liable for any loss arising from unauthorised use of your Account that results from your failure to keep your credentials secure.

You may close your Account at any time through your account settings or by contacting us. Closing your Account does not entitle you to any Prize you had not already been confirmed as winning before closure.



5. How the Game Works

The core of the Service works as follows:

  • Each Player receives a Virtual Budget and uses it to select a Team of real international archers, subject to the selection rules published in the Service (for example limits on the number of archers, positions, nationalities or price categories).
  • Before each Event, and within any deadline we set, Players may adjust their Team in accordance with the transfer rules then in force.
  • During and after each Event, Points are attributed to your Team based on the real-world performance of your selected archers, using the scoring rules published in the Service.
  • Points are aggregated into one or more Leaderboards, per Event and across the Season.
  • Prizes may be awarded based on final standings, as described in Section 7.

The selection rules, transfer rules, scoring rules, deadlines and Leaderboard structure are part of these Terms by reference. We may change them for sporting, technical, operational or fairness reasons; where reasonably practicable we will announce material changes before they take effect and will not apply them retroactively to a completed Event.



6. Free Participation and No Gambling

Participation in Fantasy Archery is free. No purchase, payment or wager of any kind is required to register, to enter an Event, to build or change a Team, or to be eligible for a Prize.

Fantasy Archery is a game of skill in which outcomes depend on Players’ knowledge of the sport and their selection and management decisions. It is not a lottery, betting product or other form of gambling, and no stake is placed on any outcome. If, in a particular jurisdiction, the Service would be treated as a regulated activity, we may restrict or withdraw the Service or the Prizes in that jurisdiction.

The Virtual Budget and any in-game balances, values or currencies are purely notional. They cannot be exchanged for money, goods or services except for Prizes awarded strictly in accordance with Section 7.



7. Prizes

We may make physical Prizes available for individual Events and for the overall Season. For each Prize the following applies:

  • The nature of the Prize, the qualifying period, the eligibility conditions and the method of determining winners will be published in the Service before or during the relevant Event or Season.
  • Winners are determined by final position on the applicable Leaderboard once results are confirmed, subject to any tie-break rules we publish.
  • We will contact winners using the contact details associated with their Account. If a winner does not respond, or does not provide the information reasonably needed to deliver the Prize, within 14 days, the Prize may be forfeited and offered to the next eligible Player or withdrawn.
  • Prizes are personal to the winner, are non-transferable and cannot be exchanged for cash unless we state otherwise in writing.
  • Where a specified Prize becomes unavailable for reasons beyond our reasonable control, we may substitute a Prize of equal or greater value.
  • You are solely responsible for any taxes, duties, import charges or other costs arising from receiving or using a Prize, and for declaring a Prize to the relevant authorities where required.
  • Employees of Fantasy Archery are not eligible to win Prizes.

We reserve the right to withhold or reclaim a Prize where we reasonably believe a Player has breached these Terms, manipulated results or the Leaderboard, used multiple Accounts, or otherwise gained an unfair advantage.



8. Fair Play and Prohibited Conduct

You agree not to:

  • use bots, scripts, scrapers, automated entry tools or any method that is not the standard user interface to interact with the Service;
  • exploit bugs, errors or undocumented behaviour, including errors in scoring, pricing or budget, instead of reporting them to us.;
  • attempt to gain unauthorised access to the Service, other Accounts, or our systems or networks, or probe, scan or test their vulnerability;
  • interfere with or disrupt the Service, for example through denial-of-service activity or by introducing malware;
  • reverse engineer, decompile or disassemble any part of the Service except to the extent this restriction is prohibited by applicable law;
  • copy, reproduce, republish or redistribute substantial parts of the Content or of any database within the Service without our permission;
  • use the Service for any unlawful purpose, or in a way that infringes the rights of others;
  • upload or transmit content that is unlawful, defamatory, abusive, hateful, harassing, obscene, or that infringes intellectual property or privacy rights;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • attempt to influence, or actually influence, the real-world results of any Event by improper means.

We may investigate suspected breaches and cooperate with law enforcement. Breach of this Section may result in point deductions, removal from Leaderboards, loss of eligibility for Prizes, suspension or permanent termination of your Account.



9. User Content

The Service may allow you to choose a username, team name, profile image or other material, or to post comments or messages (“User Content”). You are responsible for your User Content and confirm that you have all necessary rights to it and that it does not breach Section 8.

You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display and distribute your User Content for the purpose of operating, promoting and improving the Service, including displaying team names and usernames on public Leaderboards and in communications about winners.

We may remove or edit User Content that we reasonably consider to breach these Terms or to be otherwise objectionable, and may reset usernames or team names without notice where necessary.



10. Intellectual Property

The Service, including its software, design, layout, text, graphics, logos and the selection, arrangement and structure of the Content, is owned by Fantasy Archery or its licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no rights are transferred to you.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial entertainment, in accordance with these Terms.

“Fantasy Archery” and our logos are our trademarks. You may not use them without our prior written consent.



11. Real-World Data, Names and Third-Party Rights

The Service refers to real archers, real competitions and real results. The names of archers and competitions are used for the purpose of identifying real-world sporting performance and for descriptive, informational and news-related purposes.

Fantasy Archery is an independent product. It is not sponsored, endorsed by, affiliated with or otherwise connected to World Archery, any continental or national archery federation, any competition organiser, or any individual athlete, unless we expressly state otherwise. Any references to such organisations or individuals are for identification only.

Sporting results and statistics are obtained from official sources, published timing and scoring systems, or third-party data providers. We do not control those sources and are not responsible for their accuracy, completeness or timeliness. If a source corrects a result, we may recalculate Points and Leaderboards accordingly, including after a Prize has been provisionally indicated but before it has been delivered.



12. Availability of the Service

We aim to keep the Service available but do not guarantee that it will be uninterrupted, timely, secure or error-free. We may suspend, restrict or withdraw all or part of the Service, including individual Events, for maintenance, technical, legal, sporting or operational reasons.

Where an Event is cancelled, postponed, shortened or materially altered in the real world, or where a technical failure prevents fair scoring, we may declare the Event void for the purposes of the Service, exclude it from the Season ranking, or score it on a reasonable basis that we determine in good faith.



13. Disclaimers

To the fullest extent permitted by law, the Service and all Content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that the Service will meet your requirements, that scoring or rankings will be free from error, or that any defect will be corrected. Any material you access through the Service is accessed at your own discretion and risk.

Nothing in these Terms excludes or limits any right you have as a consumer that cannot be excluded or limited under the law that applies to you.



14. Limitation of Liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or in connection with the Service or these Terms;
  • we are not liable for any loss or damage caused by events outside our reasonable control, by third-party data errors, or by your breach of these Terms;
  • our total aggregate liability to you arising out of or in connection with the Service or these Terms, whether in contract, tort (including negligence) or otherwise, is limited to EUR 50,- or, if a specific Prize is at issue, to the retail value of that Prize.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law.



15. Indemnification

You agree to indemnify and hold harmless Fantasy Archery and its officers, employees and contractors from and against any claims, liabilities, damages, losses and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Service, or your infringement of any third-party right. This Section does not apply where the claim results from our own breach or negligence, and does not apply to consumers to the extent prohibited by applicable law.



16. Suspension and Termination

We may suspend or terminate your Account, remove you from any Leaderboard, and revoke eligibility for Prizes, with immediate effect and without refund of any kind, if:

  • you breach these Terms or the game rules;
  • we reasonably suspect fraud, cheating, collusion, multi-accounting or manipulation;
  • we are required to do so by law or by a competent authority; or
  • your conduct exposes us or other Players to legal liability or reputational harm.

We may also discontinue the Service as a whole on reasonable notice. On termination, the licences granted to you end, but Sections that by their nature should survive (including Sections 9 to 15, 17 and 19) continue to apply.



17. Changes to These Terms

We may amend these Terms from time to time. If we make a material change, we will notify you by a notice on the Service or by email before the change takes effect. The “Last updated” date at the top shows when the current version came into force.

Your continued use of the Service after a change takes effect constitutes acceptance of the amended Terms. If you do not accept a change, you must stop using the Service and may close your Account.



18. Privacy and Data Protection

We process personal data in accordance with our Privacy Policy, which explains what data we collect, why, on what legal basis, how long we keep it and what rights you have. By using the Service you acknowledge that we will process your personal data as described there, including publishing your username or team name and results on public Leaderboards and processing your contact and identity details in order to verify eligibility and deliver Prizes.



19. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them, their subject matter or formation, are governed by the laws of The Netherlands/Limburg, without regard to its conflict-of-law rules.

The courts of Roermond, The Netherlands have exclusive jurisdiction, except that if you are a consumer resident in the European Union you may also bring proceedings in the courts of your country of residence, and mandatory consumer-protection provisions of that country continue to apply.

Before starting formal proceedings, you agree to contact us first at fantasy@fantasy-archery.com so that we can try to resolve the matter informally. The European Commission’s online dispute resolution platform is available at https://ec.europa.eu/consumers/odr.



20. General

  • Entire agreement. These Terms, together with the game rules and the Privacy Policy, are the entire agreement between you and us regarding the Service and replace any prior agreement on that subject.
  • Severability. If any provision is held to be invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be replaced by a valid one that most closely reflects the original intent.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition or sale of assets, provided your rights are not materially reduced.
  • No partnership. Nothing in these Terms creates any partnership, agency, employment or joint-venture relationship between you and us.
  • Language. These Terms are provided in English. Any translation is for convenience only; in case of conflict, the English version prevails.
